1 Acceptation of the general sales conditions
1.1 The contract between Le Erbe di Janas and the Purchaser is valide upon acceptance, even partially, of any order from Le Erbe di Janas srl. This acceptance shall be considered tacit. While ordering with the given modalities, the Purchaser declares to read and understand every indication given during the buying procedure, and to accept the whole general sales and payment conditions below.
1.2 Shall the Client or Customer, completing the online buying procedure, print or save an electronic copy to preserve these general conditions, as said on the articles 3 and 4 of the Italian legislative decree 185/1999 about distance selling.
1.3 Shall the Client not accept the whole order condition, every damage compensation or refund, as well as any contractual or extra contractual responsibility for direct or indirect damage to people and/or things, shall be considered void.
2 Purchase modalities
2.1 Only the evident products on the electronic catalog at the time the order is sent can be bought from Le Erbe di Janas srl and this also must be visible online at the addresses www.erbedijanas.it and www.erbedijanas.com
2.2 An e-mail from Le Erbe di Janas srl will confirm the order, sent to the address previously entered by the Client. This message will carry the order Date and Hour and a "Client Order Number", to use for every other communication with Le Erbe di Janas' staff. This message will print every data entered by the client that will double check and communicate any mistake with the said modality.
2.3 Shall Le Erbe di Janas srl not accept the order, a prompt communication will be sent to the Client.
3 Prices
Every price evident for the user on www.erbedijanas.it or www.erbedijanas.com is intended VAT INCLUDED (22%). The prices might change without notice.
4 Images
The images in the description of the products are only examples. The images of the advertised products may not be perfectly representative of its features but may differ in color, size and accessory products shown in the figure. The images contained in this site are the exclusive property of Le Erbe di Janas srl and may under no circumstances be copied or used. Any use of these may only take place after explicit request and authorization by Le Erbe di Janas srl.
5 Terms of payment
5.1 Credit Card
Purchasing with a Credit Card, Visa, Mastercard, Maestro ATMs, at the end of the transaction, the banking institute will authorize only the specified amount. Le Erbe di Janas srl will never know any of the buyer credit card informations, sent through secure connection directly to the banking institute in charge. Le Erbe di Janas srl will never keep those datas in any informatic archive. Le Erbe di Janas srl will never be considered responsible for any fraud or theft while buying from www.erbedijanas.it or from www.erbedijanas.com.www.erbedijanas.com
5.2 PayPal
In case of purchase with PayPal, at the end of the transaction, PayPal will charge the right amount.
5.3 Bank Transfer
The Customer will receive an e-mail with the IBAN to pay with bank transfer. The Customer will also have to communicate the success to avoid any delay in the order. The order will then be shipped after double checking the payment on Le Erbe di Janas' bank account.
Shall the payment not be received in 15 days from the order, Le Erbe di Janas srl will consider it void and cancel it.
6 Delivery prices and modalities
6.1 Every package sent will provide a detailed Transport Order as requested from the Decree of the president of the Italian Republic 21 December 1996 696. If requested by entering the VAT Number during the ordering procedure, the package will also contain the invoice.
6.2 The Delivery prices are at customer's charge and can be seen during the order. The payment will be completed with the modality chosen during the order. The client won't receive anything else than what specified during the buying procedure.
6.3 No responsibility will be given to Le Erbe di Janas srl in case of delays during the delivery.
6.4 The client shall check, at the moment of the courier delivery: that the package is whole, not damaged, not wet or changed in anyway, checking the fastening materials as well (tape). Every damage must be promptly communicated to the courier. Signing the document, the client will lose any right to contest the delivery. Any problem with the rest, that the goods received are those you ordered, complete and the exact same, must be communicated in 5 days from the delivery, with the modalities here said.
6.5 In case of unsuccessful withdrawal of the package in 5 days from the courier warehouses because of repeated impossibility in completing the delivery to the Client, the order will be void.
7 Products availability
One shall order only the products marked as available on www.erbedijanas.com or www.erbedijanas.it. The product availability function is precise, there might be small delays from the effective stock and what reported on the site. Therefore, sometimes we can't ensure product availability. In case one or more products might not be available to be delivered, our staff, will choose one of the following solutions:
- promptly send the available goods and send the missing one as soon as available without and more cost for the extra shipping.
-ask the client to delay the order to wait for the missing goods to be available or change the missing products with others for the same value.
8 Right of termination
8.1 According the the article 5 of the Legislative Decree 185/1999, if the client is consumer (I.E. a physical person not buying the goods for a professional activity, and so, not entering a VAT Number in the order module to Le Erbe di Janas srl), he has right to terminate the buying contract for any reason, without declaring reason and explanations, except for the case indicated in 8.3.
8.2 To use this right, the Client, in 14 days from receiving the goods, shall fill out the Return form available on the site at: www.erbedijanas.com/gestione-resi .
8.3. The right of termination has the following conditions: the right is applied to the whole purchased product;
-none shall apply this right on part of the product;
-the product shall have no harm and given in its original package, with all its parts;
-according to the law, the shipping is completely customer's charge (payment and responsibility);
-in case of any damage during the transport, Le Erbe di Janas srl will communicate what happened to the client (before the 5th day from its arrival in the warehouses), to give the client the time to sue the chosen courier and ask for the refund of the goods (if covered by any warranty); in this case, the product will be give to the client to proceed, temporarily voiding the termination;
.Le Erbe di Janas srl is not responsible of any damage, theft/loss of the goods with non guaranteed shippings; As soon as it reaches the warehouses it will be examined to find any damage or changes not caused during the transport. In case the product is found damaged Le Erbe di Janas will keep a percentage of the refund as restoring expenses.
8.4 Except for eventual restoring expenses, Le Erbe di Janas srl will refund the entire amount of the already paid good (except for the shipping), via Bank Transfer, in 14 days from the goods arrival. Shall the client promptly communicate the banking data (name, surname, owner, IBAN).
8.5 The right of termination will be completely void, if the essential condition of integrity of the good is missing (package and/or contents), in case Le Erbe di Janas srl assesses that:
-essential parts of the product are missing;
-damage on the product not caused from the transport;
If the right of termination is void, truccominerale.it will refund the goods, with shipping at Customer's charge.
9 Warranty
The products bought on www.erbedijanas.it or www.erbedijanas.com are subject, if possible, to the article 24 of the Legislative Decree 2.2.2003 (Official Journal n.57 8.3.2002) about the sale contracts and the warranties on consumer goods and the specific dispositions from the Civil Code.
This warranty is applied to the defective and not working products found after buying, as long as the product has been used correctly respecting its destination and according its technical documentation and its rules.
The said warranty won't be applied in case of negligence, carelessness while using and maintaining the product, improper use. The warranty is personal, applied only to the original buyer, only for direct clients not for dealers, resellers, etc.
Any anomaly in the package shall be noticed in 10 days from receiving the goods. A written notice shall be attached to the package containing the defective product sent back to Le Erbe di Janas srl.
The defective product to be refunded will still need its package, accessories and documentation sent to the client. Sending back the package without all its parts will prevent the refund to be made.
Le Erbe di Janas srl will verify any defects and to approve the refund after this check. The request will be completed only with these documents: invoice copy or cash on delivery document, number and order date, short description of the defects. The shipping cost to send back the goods are still Customer's charge.
10 Privacy
Personal data entered during registration to the site and the order are asked to satisfy the Client requests.
Those data will be used for institutional finalities, connected or useful for our business:
-to complete one or more operations, as the contract says;
-to follow the law;
-for operating and management needs;
-for customer care and control needs;
-for strategic and operating marketing;
-to send informative or commercial material.
The personal data won't be given to third in any case. Le Erbe di Janas srl guarantees the respect for the normative regarding treatment of personal data, as said in the privacy code from the Legislative Decree 30.06.03 number 196 and the subsequent EU Regulation GDPR 2016/67. Le Erbe di Janas - Traversa Via Ghilarza, snc - 09170 Oristano (OR) is the owner of the data treatment.

12.2 For any issue or anomaly found we invite the Client to reach Le Erbe di Janas srl staff via e-mail. In almost every case, any problem is solved in a few hours.
13 Applicable law
The sale contract between the Client and Le Erbe di Janas srl, is finalized in Italy, regulated by the Italian law. To solve any civil or penal controversy about this contract, the competency is strictly of the "Foro di Oristano".
